In a situation where there is a breach of contract, the court may order the faulting party to perform his part of the contract instead of letting him buy himself out of it by paying damages for breach. This order is referred to as Specific Performance. This will be ordered only where the common law remedy of damages is inadequate. The order will not be made if it would require performance over a period of time and the court could not ensure that the defendant did fully comply with the order.
